Terms of Service

1. Introduction & Acceptance

Welcome to ScubaID ("we", "us", "our"). ScubaID is an emergency identification platform that allows users to create QR-accessible emergency profiles for themselves and their children. By creating an account or using any part of our service, you agree to be bound by these Terms of Service. If you do not agree, please do not use ScubaID.

These Terms form a legal agreement between you and ScubaID Limited, a company registered in England and Wales. References to "you" mean any person who creates an account, accesses, or uses ScubaID's services.

ScubaID is part of the Nautiq ecosystem — a suite of tools for the diving community. Your ScubaID account may in future integrate with Nautiq (divenautiq.com) for dive logging and other features, subject to separate terms.

2. Service Description

ScubaID is an emergency identification platform. It enables users to:

  • Create emergency profiles containing personal and medical information
  • Generate QR codes that link to those profiles
  • Control which fields are publicly visible, PIN-protected, or private
  • Create child-safe profiles for dependants with enhanced privacy protections
  • Receive scan notifications when their QR code is accessed

ScubaID is a technology platform only. We do not provide medical services, emergency dispatch, or rescue coordination. Always dial your local emergency number (999, 112, or 911) in an emergency.

3. Voluntary Data Publication

By activating your Emergency ID, you voluntarily choose to publish personal and medical information. You retain full control over what is visible:

  • Public — visible immediately when your QR code is scanned, without any authentication
  • PIN-protected — visible only after a responder enters the PIN you set and share
  • Private — visible only when you are logged into your account

You are solely responsible for deciding which information to publish and at what visibility level. ScubaID does not verify the accuracy of any information you provide. Publishing inaccurate medical information could be dangerous — please keep your profile up to date.

4. Account Registration

To use ScubaID, you must create an account with a valid email address. You agree to:

  • Provide accurate, complete information at registration
  • Maintain the security of your account credentials
  • Not share your account with others
  • Notify us immediately of any unauthorised access to your account
  • Not create multiple accounts for the purpose of circumventing limitations

You must be 18 years of age or older to create an account. By registering, you confirm that you meet this requirement.

5. Child Profiles

ScubaID allows account holders to create child profiles for dependants under their care. By creating a child profile, you confirm that:

  • You are the parent or legal guardian of the child
  • You have the legal authority to publish the child's information
  • You understand that child profiles display limited identifying information for safety (initials and surname rather than full name)
  • You are responsible for keeping the child's medical and contact information accurate

Child profiles are designed with enhanced privacy. The child's full first name is not shown on public emergency pages. Sensitive medical fields are PIN-protected by default. Parent/guardian contact details are shown prominently to assist anyone who finds the child.

You must not create a child profile for a person who is not under your legal care or guardianship.

6. Privacy Tiers & Emergency Access

ScubaID operates a three-tier visibility system:

  • Public tier — accessible to anyone who scans your QR code
  • Extended (PIN) tier — accessible after entry of your emergency PIN
  • Private tier — only visible to you when authenticated

We strongly recommend setting sensitive medical fields (blood type, allergies, medications) to PIN-protected rather than public. Do not share your emergency PIN with people you do not trust with your medical information.

ScubaID does not control who may physically obtain or scan your QR code. By making information public, you accept that anyone who scans the code may view it.

7. QR Codes & Physical Tags

Your QR code links to your ScubaID emergency profile. You are responsible for:

  • Printing, applying, or attaching your QR code to equipment, wristbands, or other items
  • Ensuring your QR code remains legible and scannable
  • Replacing damaged or illegible tags promptly
  • Deactivating tags you no longer wish to use

ScubaID does not supply physical tags unless explicitly stated. Any third-party physical tags, patches, or accessories are governed by the third party's own terms. ScubaID is not liable for the failure of any physical tag to be scanned in an emergency.

8. No Medical Advice

ScubaID is not a medical provider, medical device, or emergency service. Nothing on ScubaID constitutes medical advice. The information displayed on emergency profiles is provided for informational purposes only and represents what you have chosen to enter.

ScubaID accepts no liability for:

  • Any medical decisions made by responders or third parties based on information displayed
  • Incorrect, outdated, or misleading information you have entered
  • A responder's failure to access or act upon your profile
  • Consequences arising from a QR code being unreadable, inactive, or inaccessible

Always contact emergency services (999 / 112 / 911) in any medical emergency. ScubaID is a supplementary tool only.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • ScubaID is provided "as is" without warranty of any kind, express or implied
  • We do not warrant that the service will be uninterrupted, error-free, or available at any specific time
  • We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of or inability to use the service
  • Our total aggregate liability to you for any claim arising from these Terms shall not exceed the greater of £10 or the amount you paid us in the twelve months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Data Analytics & Aggregate Insights

ScubaID analyses aggregate, anonymised data to improve services and generate commercial insights. These insights — such as scan trends, geographic patterns, certification distribution — may be shared with partners, dive operators, tourism boards, or insurance providers.

  • All aggregate data contains no personally identifiable information
  • Aggregate insights may be shared with partners, researchers, dive industry bodies, or used commercially
  • Individual user data is never personally identifiable in any aggregate analysis
  • We do not sell personally identifiable data
  • You may opt out of anonymous data collection via your account settings (this feature is in development)

11. Data Accuracy & Your Responsibility

You are solely responsible for the accuracy, completeness, and currency of all information in your profile. This includes medical details, emergency contacts, and any other data you choose to share.

We strongly recommend reviewing and updating your profile:

  • At least annually
  • After any change in medication or medical condition
  • After a change in emergency contacts
  • Before any dive trip, holiday, or adventure activity

Outdated or inaccurate information could cause harm. ScubaID is not responsible for consequences arising from inaccurate data you have entered.

12. Intellectual Property

All intellectual property rights in the ScubaID platform, design, code, and brand assets are owned by or licensed to ScubaID Limited. You may not copy, reproduce, modify, or distribute any part of the service without our express written permission.

You retain all ownership rights in the personal data you enter into ScubaID. By using the service, you grant ScubaID a limited, non-exclusive licence to store and display your data for the purpose of operating the service.

13. Account Termination

You may close your account at any time. Closing your account permanently deletes all profiles, emergency tags, and scan history associated with your account. This action is irreversible.

We reserve the right to suspend or terminate your account if we reasonably believe you have:

  • Violated these Terms
  • Used the service for unlawful purposes
  • Created profiles for persons without authorisation
  • Engaged in abuse, harassment, or fraudulent activity

If we terminate your account for policy violation, we are not obligated to provide a refund of any paid subscription.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by displaying a notice within the app. Your continued use of ScubaID after the effective date of any changes constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you should close your account before the changes take effect.

15. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes, except where local mandatory consumer protection laws may provide otherwise.

16. Child Safety & Safeguarding

ScubaID provides features specifically designed for child profiles. By creating a child profile, you acknowledge and agree that:

  1. You are the parent or legal guardian of the child, or have explicit authorisation from the parent/legal guardian to create an emergency profile for the child.
  2. Child profiles are designed with enhanced privacy protections. The platform automatically applies name obfuscation and restricts the display of certain personal information on public emergency pages.
  3. You are responsible for the accuracy of the information provided in the child's profile, including emergency contacts and medical details.
  4. ScubaID does not independently verify the relationship between the account holder and the child. If you become aware of any misuse, please contact us immediately.
  5. Child profiles can be deleted at any time by the account holder. Deletion is permanent and removes all associated data.
  6. ScubaID reserves the right to suspend or remove any profile that we reasonably believe is being used in a manner that could endanger a child.
